Overview
A Labour Market Impact Assessment (LMIA) is an important document required for many Canadian work permits. It is issued by the Canadian government to confirm that an employer needs to hire a foreign worker because no suitable Canadian citizen or permanent resident is available for the job. This process helps protect job opportunities for Canadian workers while also allowing employers to fill labor shortages when necessary.
Once an employer receives a positive LMIA, the foreign worker can apply for a work permit to legally work in Canada. Although a work permit does not provide permanent residency, it can help workers gain Canadian work experience and may later support their application for permanent residence through different immigration programs.
Labour Market Impact Assessment (LMIA)
Most Canadian work permits require a Labour Market Impact Assessment (LMIA), which was previously called a Labour Market Opinion (LMO). An LMIA is a document that a Canadian employer must obtain before hiring a foreign worker. It proves that: There is a real need for a foreign worker The employer could not find a Canadian citizen or permanent resident for the job This rule ensures that job opportunities are offered to Canadians first while also protecting the rights of foreign workers by ensuring fair wages and working conditions. The LMIA is issued by Employment and Social Development Canada (ESDC) after they review the employer’s job offer and assess whether hiring a foreign worker will have a positive or neutral impact on the Canadian labor market.
2 Steps to Receive an LMIA-Based Work Permit
Step 1: Apply for a Labour Market Impact Assessment (LMIA) The Canadian employer must submit an application to Employment and Social Development Canada (ESDC) to request an LMIA. During this process, the government reviews the job offer and checks whether the employer tried to hire Canadian workers before offering the job to a foreign worker. If the government approves the request, the employer receives a positive LMIA, which allows them to hire the foreign worker. Step 2: Apply for a Canadian Work Permit After the employer receives a positive LMIA, the foreign worker can apply for a Canadian work permit through Citizenship and Immigration Canada (CIC). To apply for the work permit, the worker must include: The written job offer from the employer The positive LMIA document Additional documents may also be required depending on the province and type of work.
Important Information
In some situations, a foreign worker may not need an LMIA to obtain a work permit. These cases are called LMIA-exempt work permits. It is also important to understand that a work permit is temporary. It allows a foreign worker to work in Canada for a specific period but does not automatically grant permanent residence. However, Canadian work experience gained through a work permit may help individuals apply for permanent residence through other immigration programs.
